Workers Comp, Attorney Fees?

I spoke to a lawyer (in California)regarding an on the job injury. He told me that it is my duty to file for Disability Insurance. And that he'd represent me in My Workers Comp case. He said he'd charge 15% of any settlement I'd receive from Workers Comp.

Does this mean that I can receive one lump payment from WC, from where he takes 15%? Or would WC give me a weekly check (until I recover) and does he get 15% from my weekly check? Thanks in advance.

CUCH is correct---but also keep in mind...if you are given california state disability while you have a workers comp claim...you will be paying the state back the disability payments.and yes you would receive one lump sum, minus the 15%
you can get the worker comp company to give you weekly payments...but not usually unless your case is really Strong...if you got the advanced payments...again these will be deducted out of your settlement.

also...settlement for work comp are not a get rich thing...and it usually drags on for a very long time.

Worker's Comp in Texas - 2 jobs, injured at 1?

"My friend" has a co-worker named "Linda". "Linda" works 2 jobs, one of which is M to F 830 to 430 M to T, F is 9 to 12. So that is her full time, primary job. She also has a 2nd job where she works weekends and the remainder of her Friday. "Linda" was recently injured at her 2nd job and is using the benefits of workmen's comp. It is not confirmed if at her second job she is full or part time since it is retail, but she is getting the benefits via check. "Linda" continues to work at her 1st job and her injury does cause some conflict because it has to do with her hands. My question is, what she is doing is that fraud, shouldnt she be at home collecting 2 checks?? I need to know what is going on here. I really cant obtain a straight answer via internet. Any input is appreciated...

Basically she is ripping off he system, since she can work and perform. SOrry would report her as in you are the one with insurance premiums going up that is in fact paying her.
That question will be asked in wc court. They will ask everything and anything to try to prove that she was stretching the truth. I injured my back at in 2001...to this day...I am still getting injections in my back and cannot sit or stand for too long. I have a paper pushing job as a medical biller...but I can no longer do the "pastry" thing I loved to do. Trust me...they make you jump through hoops...and if they find her "fraudulent" she will get into trouble. I worked at a major insurance company...and they send investigators to spy on you and WATCH everything to see what you are doing. I had this happen to me also...but it came back that I have altered everything in my life not to aggravate my current ongoing injury. Someone is always watching.Insurance premiums are so high do to fraud...and they make money by not paying any out. I was diagnosed with a pulled hamstring by Workman's comp Dr..and after three of my doctors did testing, MRI's and physical therapy.they mis-diagnosed me and now they have to take care of me for this problem that will affect me the rest of my life. I actually herniated several disc and now they sit on my sciatic nerve which is extremely painful.

My fiance works at a disturbution center in Louisville Kentucky. He has been there for about 4 months or so, he is full time and in the union. He has tendenitis (sp) in both of his arms. He has known about it for a whil but not had insurence until recently to go to the doctor. He has not have a day off in over 3 weeks, his arms are hurting him so bad he can barley lift anything ( which it the major part of his job) He called in today to tell them he was going to the doctor today to have his arms looked at. his boss said " well are you going to be at work?" my fiance told him he didnt know it was all up to what the doctor said. so his boss told him if he did not come in today even if he went to the doctors office and got a doctors note then he was fired. My fiance has never missed a day of work and is one of there better employees. Are they able to tell him he can not miss one day even for a health problem?

As you indicate he is in a Union, he should contact his Union Rep.

If he is still within a probationary period and the problem is due to a pre-existing condition it will depend on what the Union contract specifies...they may be within their rights to terminate; however, the Union Rep. can file probably grievance and as he has not missed any work in the past and he has a doctor's note, get him reinstated and if he cannot work, see if he qualifies for disability leave (if past the probationary priod w/Dr.'s certification) or FMLA (if unable to work due to a pre-existing condition with Dr.'s certification), Workman's Comp. (if past the probationary period and no pre-existing condition), or return to work with restrictions-light duty until certified able to return to work (if on disability, Workman's Comp. or working with restrictions, most union employers have the right to send him to a Dr. of their choosing for an impartial medical exam to determine a worker's ability to work and the findings of that physician will be binding).

Only if your fiance claims this as a work injury, can they not fire him. Otherwise, yes they can. KY is an AT WILL state, and they don't have to give a reason to fire him at all.
depending on the state that you live in, like in New Hampshire it is not okay for an employer to put the employee in danger when they need medical attention.
They can tell him anything they want. That's why he is in the union. It's their job to make sure the employer is acting correctly.

If he had a note from a doctor indicating that he should not work then the employer can't justifiably fire him. The employer should know this, it would open him up to problems with the union plus a wrongful termination suit from you. If he is still on inital probation, however, they can fire him without cause.
Unfortunately friend, it appears employers can do whatever they want these days. I hope he can find some other employer who treats him better. As one who has been going from part time job to part time job for the last 2 years I can tell you, the big boys hold all the chips and anyone who can keep a job should consider themselves lucky.

look into the labor laws of your state.
There are some that state employees must be given 2 days off each week.

then you can call around the yellow pages for employment lawyers. Ask them, if they can point you in the right direction since its not an actual case YET.

A few places I worked HAD to give you 2 days off per week...unles you were upper mamnagement that was paid salary.
But hes paid hourly, so I would look into it.

I work in Tennessee, which is also an at-will state. While it does mean that you can terminate employment with out cause or reason, there are federal laws that protect individuals from being fired when they are injured. It breaks federal labor regulations to fire somebody who is under doctor's care for a mental or physical problem that is preventing them from performing their job function (to an extent).

How does this help you? If he can prove he was fired for seeking medical treatment, you have a case. If the employer says he was fired for any other reason under the sun (or no reason at all...in an at-will state) it may be hard to fight.

Won't it be better to make guns illegal?

The second amendment says the right to bear arms. However, I think it's flawed. If there's no gun at all, except in the army, things would be totally better.

In my state there are many sex criminals and rape. So many women are being scared to men. Every time I see men walking at the stree, and I see woman they will get scared and walk fast even I didnt do anything wrong. They would do thing just because sex crime is very high. Witness in court.?

I'm due in court in 8 hours time to testify about my ex hitting me on a 2nd common assault offence.

The CPS have asked me to attend as witness, which I agreed (but personally didn't want to - stress!) - because otherwise they would summon me.

They are the ones prosecuting, not me. I dont think I can attend, what will happen if I dont show. I should be in bed now, but can't sleep, worrying about this.

Don't get me wrong, my ex is a complete idiot and has lost me for life for what he did, but I cant face the court thing - feel ill.

Sorry about your situation.

The CPS have behaved badly but, you have left it very late to sort it out. If you cannot possibly face it then you must contact the CPS and explain that you are too ill to attend, as soon as possible. Get someone to ring for you if neccessary. See your G.P. and then get some legal advice from the Citizen Advice Bureau or Victim Support.

Try not to worry please. You are the victim here. Whilst you perhaps have a duty to attend, there is also a duty for you to be looked after and advised properly and that hasn't happened.
Oh darling - I know this is hard, but you have to go. If you have agreed and don't go, they will issue a bench warrant and then you'll be in trouble which is an absolutely wrong turn in these events. Court isn't so bad - you CAN do it. Just go in and tell what you know and leave. Don't let the stress get to you. It's like letting him win again. Be strong. And get some rest. Local laws vary but most courts can compell you to tesify and penalize you if you don't. If they've gone to the trouble of bringing him to trial I doubt they'll be terribly amused if you don't show up.
Having worked in the court system for over 26 years, I can only say that you do need to appear in court and you do need to testify. In Domestic Violence cases, it is always the District Attorney or Prosecutor that prosecutes. Sometimes the victim just does not have the energy or will to do it. Go to the court first thing in the morning and find where the prosecutors office is and ask to speak with the person trying your case. Talk with him or her and tell them you fears. They will help you through this.

I have seen women who have not appeared in court against their spouse/boyfriend/ex or have asked the court not to prosecute them and have had the woman get brutally assaulted again and in one case, murdered. He is being charged with a 2nd offense and obviously has an assaultive record. He needs to be sent a message. Go to court and testify. Hopefully when he gets out of jail or prison, he will leave you alone. You can only hope.

you will be questioned by your lawyer then a second time by your husband's lawyer. This process is known as cross examination. This questioning is to see if your testimony is accurate. Rest assured you ex will have to go through the same process with your lawyer when he or she cross examines him.
I really feel sorry for you, you are left in a position where you obviously feel you could be putting him away.

Without murdering someone how can I get the police to turn up at my house before hell freezes over?

I'm not going to rant or rave, or be sarcastic, but I'm not going to be popular.
I'm a Police Officer and I've literally just finished 3 nights. just a handful of officers to cover a v large city.
In those 3 nights I've dealt with Parents hitting kids, spouses beating the other, a young lad saying he was going to commit suicide, an attempted Murder! a racial assault, a glassing, an attempted car break and over two dozen assaults (usually drunk mates who've fallen out) and that's in between taking statements, storing exhibits, collecting clothes for prisoners and calling the statistic people to record it all! I must state the majority is alleged, of course!
I'm in no way complaining. I am so proud to do this job and attempt to help all I meet.
I just want to say that 99% of us are trying our best, our hands are so often tied by procedure and what is required we can't always be there straight away. We're not always right, but your average copper is really trying, I promise.

I had an 'incident' earlier this year - chavs shooting ball bearings at my windows, police called, hour later - chavs still there, police not. My dad ended up ringing the police and threatening them with reporting them to their Chief Constable, the ex chief constable, the ex chief constable of the Isle of Man (very random!) and a call to my MP (who he knows). They turned up three minutes later.

So threats. Or tell them you're about to commit a racially motivated crime yourself :P

I assume by the response time you are talking about the good old UK police? Tell them someone has broken in and that you think they have a gun, scream N0oooooooo and put the receiver down, this should armed response the full works there in no time. Of course they might be a tad annoyed and book you for wasting police time.

I reported an attempted break-in once and while making the call I pretended to call my wife to pass the shotgun (which I haven't got) to scare off the intruders. The operator heard me say that, and they were at the door in under a minute!
Call the emergency number (911 here) and hang up... they should be there in minutes. Worked with my then 1 year old who played with the phone and I just grabbed it and hung up. By accident he had dialed 911 though and Police came ASAP to check on us .should not do it lightheartedly though, calling the Police for no reason could be fined.
If they don't think it is a real emergency they take their time. I had nasty neighbors who put their basketball hoop right by my window. I got rude one day and things escalated, finally the police showed up, hours later. So, explain your situation over the phone, Especially if you are threatened or feel threatened. Do not call in fake calls,cause you could get arrested for that.
Nice story I heard a few weeks ago
Guy sees yobs trying to break into his car - phones police to request assistance. Told very sorry but nobody around - no police officers available, maybe in an hour. Man puts down phone.
Phones police a few minutes later says "Don't bother to send anyone in an hour. I've sorted them. I shot them" Puts down phone.
A couple of minutes later, 3 police cars, lights flashing, ambulance, armed police vehicle all screech to a halt outside the guy's door.
He answers the door and says "I thought you said there wouldn't be anyone available for an hour"

You don't say why you want the cops - could it be trouble with neighbours or the vegetables (my husband's term for the local neds cos they haven't a brain between them)? If you've been calling and getting nowhere, do as some of the other replies have suggested. You could just sit and keep phoning constantly until someone decides to make a guest appearance OR go down to the cop shop in person - they can't ignore you if you are right there in front of them.

Without a W4 form am I still employed?

I started a night position at a hotel that is under new ownership, and for about a week now i havent signed any paper workproving that i work there other then detailed e mail from the manager.I was offered a more organized job and left on an e mail stating it was my last day in the night position and was going to a different hotel and could work still but as a part time day crew.He has declined and wants a W4 form.Was i fired or did i quit?When should i get paid?No other employees know when pay day is.Most as well have not signed any paper work.Help

This sounds a little fishy to me. You should know when payday is and that is when you should get paid. Keep track of how many hours you worked and expect a check soon. It depends on the situation. Yes, there are homeless people that I feel generally sorry for, but I believe there is always work and always a place to stay at, no matter where you are. Even a homeless shelter is at least a place to sleep at for a little while. It's just a matter of if the person in mind is actually wanting to change their life, or just looking for an easy way to get money. And I'll give you two examples of situations that actually happened.

There was one time when my husband's boss was approached in the parking lot where their store is. Some guy walked up to his boss and asked for money. His boss' response? He told the guy he wouldn't GIVE him money, but asked the guy to wash the window's on his car, and he'll PAY him for the work. The guy said no.

Then, several years ago, my ex and I were approached, when we parked in the lot for our bank, by a lady in a MINK coat asking for money. I'm sorry, but if you're wearing a MINK coat, you don't need money. We didn't give her anything that time.

No - because your boyfriend was arrested on a felony charge stemming from a warrant which was also used to violate the probation on the misdemeanor. Your bf sounds like he also spent time in prison on the suspended sentence for the misdemeanor conviction PLUS the one felony conviction - which you refer to as a warrant. The judge probably sentenced him to 18 month concurrent sentences for both convictions.

Unless you live in a state with automatic expungement, which is unlikely, both convictions are on your bf's record for life - unless he applies for a pardon from the governor.

The question was also very confusing and I doubt that accurate information was portrayed. He needs to have an exemplary record in the Army reserves, in life and with you to be eligible for a pardon down the road. Again, these depend on the laws for your state - in MD, even with a pardon, one has to wait 5 years for an expungement. If you live in FL, your bf's 2 convictions are never eligible for expungement.

Can't tell what you are talking about. The phrase "served his warrant" has no meaning that I can discern. I can say this much, that a felony charge is not the same as a felony conviction. He could have been charged with a felony and then reached a plea bargain the plead to a misdemeanor.

What are you on? Libel is not a crime, never has been and never will be. So you cannot be arrested. It is not a criminal matter but a civil matter. That means that he person who has been libelled can sue the nasty person who said bad things about them, with the idea of winning damages.

These cases are heard in the civil courts and not the criminal courts. There may have been some things said that could fall within some criminal law or another, I never saw them all, however, in the case of libel, it is a civil matter.

I am writing a letter to our chief of police because the road we live on isn't safe. The posted speed limit is 25mph, and yet people go well over 40 most of the time. Our road is a pretty high traffic area stretching about 2 miles N to S... with NO stop signs or etc. So I am writing to him so maybe they will put some up as well as a crosswalk. (children cross our street everyday to get to school which is a block to the west) I was thinking about either making a petition, (which isn't really needed because all he'll do is take the issue to the next city council meeting) or making extra copies of the same letter to have all our neighbors sign. Either those ideas or writing one, and having everyone sign their names on it... No matter how it goes, I just don't want them to overlook this matter. I want them to know just how many people have the same concern... (numerous young children live on our street)

So what do you think I should do?? Please help!!! Thank you!

Having everybody on the block sign it is a good idea. I'd be sure to send a copy to each city council member and the mayor also. But don't stop at that - write to the local paper and get your neighbors to go to the city council meeting. Politicians can ignore paper, but they can't ignore an angry crowd seated 10 feet away. I don't know how roads are regulated where you live, but you might also need to get the state and the state traffic department involved - contact your state legislator.

From what I know about my town, getting a traffic light put up takes quite a bit of effort but a crosswalk with a "watch children" sign shouldn't take up as much time. Best wishes.
Sounds like a worthy approach. You might want to include any accident statistics for that area of road to support your contention that it's a problem. Also consider videotaping examples of the problem and providing the video to the city council members.
The proper way to do this is through the DMV or if there is a traffic control department report it there. The cheif of police cant get you a stopsign. If the road is as bad as you say it is, I'm sure he wont mind joining in on your request. They dont like responding to accidents as much as you dont want to be in one. You can get accident statistics on a many cities' websites nowadays. Or you could go down to city hall and ask them where to get them.

Anyway, make the police your allies in this one. I'm sure they want to help.
It's a good idea, but not to the chief of police. The police are only responsible for enforcing the laws, they don't make them. You need to contact your city's planning or traffic engineering department (may go by different names) so they can look into it. If they don't act, then YOU go to the city council meeting and bring it up, and take a few neighbors with you. Good luck =)

Will this show up on a criminal background check?

I was arrested last year in July, 2006 (bum rap) by the local police. When I appeared at court, the case was not called. My lawyer approached the bench and the Judge said there was no record or case number. The court clerk said they had nothing either. My lawyer told me that no charges had been filed, so It never went to court. I later received a letter in the mail (from my lawyer to the prosecuting attorneys office) stating that he is representing me and to contact him also if any further action will be taken. My lawyer stated again that this case was not pursued. That was last August, 2006. Will this show up on a criminal background check? I have heard conflicting stories that since it never went to court, that it will not show up. Thanks in advance for any replies

If you weren't convicted and didn't plea, then I don't see how it can fairly show up on a criminal background check.
Most likely the cops lost the paperwork or failed to follow their normal procedures for getting a case to court. It seems unlikely it will show up on a background check UNLESS the cops have already recorded the charge on computer

I would find a reputable website online and go ahead and pull a criminal background check on yourself to find out if the charge is on there or not. It may cost you $20 or $30 bucks but it would probably be worth it to find out yourself so that you can find out what to do about it if it is on there. I think it would be better to do that then to wait and have prospective employers, etc. find out first.

Well you heard it from the man yourself, the judge said no record or case. So no worries. But the other party that you got involved with and the reason for the arrest, can file charges still against you, the statue of limitations, you have to check.
I don't know whether you are in Canada or the US, but from the info you have given here I would say that it would not appear on your criminal record check. That being said, I also suggest that you spend the $25 (that is what it costs in Canada at least) and have a record check done on yourself. That way you will know for sure if there is anything on your criminal record for a potential employer when they ask for one. But I think that you are without this particular record in the system-no court appearance and conviction then no record.

Here how they usually do it in cases like this...which are rare thank god.

Civilians try the case. If the outcome is not guilty, or the punishment is too light for the military's taste they will then try him. Its not double jeopardy for some reason I can't remember, but they will most certainly "do him" the way they see fit.

I do not know exactly if India courts work the same as other nations. The reason for this is that every society develops a coherent jurisprudence in concert with the evolution of its society.

But i only make about $300 a week, not to mention rent and college tuition, there is no way i can pay that off in a short period of time... I guess my main quesion is if i pay if off slowly over a period of like 2-3 years... does it hurt my credit, and if so by how much should i expect it to drop.?

Ask the agency how they handle payment plans. Specifically, ask that if you set up a payment plan and continually make payments in a timely manner, will they not credit report your debt. Some will comply with your request, some won't. It also depends on your payment plan amount. If it's large enough, some of them might comply with your request.

I would try going to your local bank and explaining the situation if they will give you the loan to pay off talk to the collection agency and see if you pay it off in one payment if they will take it off your report. Then when you make payments to the bank it will help your revolving credit. If the bank will not go with you the payments will hurt a little but you can bring it back up just make sure the payment you set up is doable for you...and NEVER pay more or less than the agreed amount that sends flags up, even if you can afford more one month. I can answer your question by explaining what I have been through with credit in the states, where a persons worth is measures by his credit, it seems.
When I arrived in the states 5 years ago from the UK, My credit score didn't come with me so I had to start at 400.
On top of which I needed to get a credit card, or store card to start building credit, but couldn't get them approved because of my credit score.catch 22.
On top of all this, I am paying my wife's debt from her college days.
Only 5 years later my credit is almost 800. I did it by getting a couple of 'easy to get' credit cards like Capital One who are terrible companies and have an annual fee, but it was enough to get up to the next level where I could then get store cards. Having a small balance each month while paying at least the minimum payment each month is the ideal..credit score wise. Not paying them off, or having high balances, but having a slight balance and NEVER miss a payment. Keep asking for credit limit increases and after you get more established with higher limits on some credit cards, close some store cards and other cards so you don't have too much open, that can also bring down your score.
You want to minimize the amount of inquiries creditors check your credit because each one stays on your credit for two years and brings down your score every time (despite what other people may tell you).
Pay at least the minimum each month and your score WILL NOT do down 1 point. Just go to annualcreditreport.com to get your free credit report and make sure it's accurate and it will tell you more areas where you can improve your credit.
