Why is Consensual inc3st A Felony in Many US States Even When Those Consenting Are Gay Or Use Contraceptives?

Assuming the hype about mutations that hypothetically occur through multiple generations of immediate inc3st so as to justify moral fascism are true...

What if the parties involved use contraceptives or are gay? Why should they go to prison then?

Just for being "EUWWWW THTS GROSS!!"?

Should "gross" carry a prison sentence? if thats the case haven't most people done something gross thus deserving to go to prison?
Answer:
Because the laws are poorly written, and do not really take into account a century of social change, let alone the technological changes in contraceptives over the past century.

It's just another example of a law written back when reality was different, that hasn't been updated.
The reason its illegal is that the term incest itself denotes one of the people being underage.

And the mutation thing isnt just hypothetical, there is ample scientific evidence that it occurs.
To make it legal would suggest supporting it.
It sounds disgusting and any accidental pregnancies would be devastating, emotionally and physically.
First, if only gay people are allowed to commit incest, wouldn't that be discrimination against other consenting adults that want to commit incest? Secondly, the only thing that can completely prevent pregnancy is abstinence. Third, yeah, incest is gross and should be punishable, but not because it is gross. Mainly because it is wrong, perhaps along the lines of beastiality; it's just plain wrong.

contraceptives are not the same as homosexual activity, since contraceptives have been known to fail on occasion, approximately 1-28% of the time. Genetic similarity has shown to bring about an increase in harmful genes in one person, i.e., more chances of having a disease, harmful trait. So one out of every four incestual couples could, theoretically have a baby, in that case, who would have a seriously increased chance of having a genetically challenged life.

In the name of incest, a lot of rape and sexual abuse goes on. That is not something we should lightly ease the restrictions on.
