I filed for disability in January, 05. I was denied. Then I appealed. I was denied. Now I have an attorney and he filed for a court date in January 06, but I am still waiting. Why is it taking so long?

You can ask your attorney to contact them and find out the status of you case. That usually works.
because they have about 1 million cases to hear
Their case load is humungous and they are understaffed.

My friend I feel your pain and know how you feel I went through it in 1999,when I filed my claim and was denied and refiled it again and like you I got a legal aid lawyer and my case did not come to court until early 2001. They do that hoping you will give up and go away plus there docket is full as well but most of the time it is because they want you to give up and go away that is what I hate about them but I did not go away and I won plus so what if you win your case it will be retroactive back to when you started and you will get all of that back money ok.
Like anything else, its a waiting game, I can relate to your story, I went through a lot getting my Social Security disability, I filed in 2003 and got denied 3 times before I decided to get a lawyer.he told me to appeal again and wait for the denial, which it was, I informed him and he took over my case. I signed papers and waited, at the same time I was going through getting more benefits from the VA and getting more medical information which I supplied to my lawyer.After all the crap I went through, the Administrative Law Judge made a decision fully in my favor, My Lawyer and I did not even have to go to the hearing, he decided the case from the information in my file. A blind man filed 3 times and was denied, I heard this from my lawyer and there are other stories from other people that have went through a lot of crap to get their benefit, this is due to some people committing fraud, my best friend has been deemed 100% disabled through the VA and has end stage liver disease, his meld score as of today is 31, at 40 you die, he still has not heard anything from the SSA. they want you to give up so hang in there,I know its a hard thing to do. There are many people that are waiting too. Good Luck
